مع عدم الإخلال بحكم المادة ( ١٣٥ ) من قانون الإجراءات الجنائية . لا يجوز القبض على عضو نقابة الصحفيين أو حبسه احتياطيا لما ينسب إليه فى الجرائم المنصوص عليها فى المواد ١٧٩ و ١٨١ و ١٨٢ و ١٨٤ و ١٨٥ و ٣٠٣ و ٣٠٦ من قانون العقوبات بسبب مواد صحفية صدرت عنه أثناء ممارسة المهنة . وتحرر النيابة العامة فى هذه الحالة محضرا بما حدث تبلغ صورته لمجلس النقابة .
