مع عدم الإخلال بأحكام قانون المرافعات ، تعتبر المعاشات والإعانات نفقة ، لا يجوز تحويلها أو الحجز عليها أو التنازل عنها للغير إلا لنفقة محكوم بها أو لدين للنقابة ، وذلك في حدود الربع وعند التزاحم يفضل دين النفقة .
