اذا زادت الوصايا علي ثلث التركة واجازها الورثة وكانت التركة لا تفى بالوصايا او لم يجيزوها وكان الثلث لا يفى بها قسمت التركة او الثلث على حسب الاحوال بين الوصايا بالمحاصة . وذلك مراعاة الا يستوفى الموصى له بين نصيبة الا من هذه العين .
