تصح الوصية لاماكن العبادة والمؤسسات الخيرية وغيرها من جهات البر وللمؤسسات العلمية والمصالح العامة وتصرف علي عمارتها ومصالحها وفقراتها وغير ذلك من شئونها ما لم يتعين المصرف بعرف او دلالة ، وتصح الوصية لله تعالي ولاعمال البر بدون تعين جهة و تعرف في وجوه الخير .
