اذا كانت الوصية بالمرتبات لجهة لها صفة الدوام مطلقة او مؤبدة يوقف من مال الموصى ما تضمن غلته تنفيذ الوصية ولا يوقف ما يزيد علي الثلث الا باجازة الورثة .
واذا اقل الموقوف اكثر من المرتب الموصى به استحقته الجهة الموصى لها واذا نقصت الغلة عن المرتب فليس لها الرجوع علي ورثة الموصى .
جواز استيلاء الورثة علي العين التي خصصت لاستيفاء المرتب من غلتها
