تسقط الوصية بالمنفعة بوفاة الموصى له قبل استيفاء المنفعة الموصي بها كلها او بعضها وبشراء الموصى له العين التى اوصى له بمنفعتها وباسقاط حقه فيها لورثة الموصى بعوض او بغير عوض وباستحقاق العين .
حق الورثة في بيع نصيبهم في العين .
