تستوفى المنفعه بقسمة الغلة او الثمرة بين الموصى له وورثة الموصى بنسبة ما يخص كل فريق او بالتهايؤ زمانا او مكانا او بقسم العين اذا كانت تحتمل القسمة من غير ضرر .
