اذا كانت العين الموصى بمنفعتها تحتل الانتفاع او الاستغلال على وجه غير الذى اوصى به جاز للموصى له ان ينتفع بها او يستغلها علي الوجة الذى يراه بشرط عدم الاضرار بالعين الموصى بمنفعتها .
