اذا كانت الوصية بالمنفعة لقوم غير محصورين لا يظن انقطاعهم او لجهة البر وكانت مؤبدة او مطلقة استحق الموصى لهم المنفعة علي وجه التابيد فاذا كانت الوصية مؤبدة او مطلقة لقوم غير محصورين يظن انقطاعهم استحق الموصى لهم المنفعه الى انقراضهم .
ويجب مراعة احكام المادتين السابقتين اذا كانت الوصية بمدة معلومة المبدا والنهاية او بمدة معينة القدر غير معلومة المبدا والنهاية .
