اذا كانت الوصية بعين من التركه او بنوع من انوعها فهلك الموصب به او استحق فلا شيء للموصي له واذا هلك بعضه او استحق اخذا الموصى له ما بقى منه وان كان يخرج من ثلث التركه والا كان له فيه بقدر الثلث .
