اذا كانت الوصية بنصيب وارث غير معين متن ورثة الموصى او بمثل نصيبة استحق الموصى له نصيب احدهما زائدا علي الفريضة اذا كان الورثه متساوين في المراث وقدر نصيب اقلهم ميراثا زائدا على الفريضة ان كانوا متفاضلين .
