إذا جاءت الحامل في وقت واحد او في وقتين بينهما أقل من ستة اشهر بولدين حين أو اكثر كانت الوصية بينهم بالتساوي إلا إذا نصت الوصية علي خلاف ذلك .
وإن انفصل احدهم غير حي استحق الحي منهم كل الوصية وإن مات احد الاولاد بعد الولادة كانت حصتة بين ورثته في الوصية بالاعيان وتكون لورثة الموصي في الوصية بالمنافع .
