إذا كانت الوصية بالمنافع لاكثر من طبقتين لاتصح الا للطبقتين الاولين فإذا كانت الوصية مرتبة الطبقات يكون استحقاق الطبقة الثانية عند اليأس من وجود احد من أهل الطبقة الاولي أو انقراضهم واليأس من وجود غيرهم مع مراعاة وجود الاحكام الواردة في المادتين السابقتين .
وإذا انقرضت الطبقات كانت العين تركة إلا اذا كان قد اوصي بها او ببعضها لغيرهم .
