إذا كانت الوصية لمن ذكروا في المادة السابقة بالمنافع وحدها ولم يوجد منهم احد عند وفاة الموصي كانت لورثة الموصي . وان وجد بعدة من المستحقين إلي حين انقراضهم فتكون المستنفعة لورثة الموصي وعند اليأس من وجود غيرهم من الموصي لهم ردت العين لورثة الموصي .
