تلزم الوصية بقبولها من الموصي له صراحة او دلالة بعد وفاة الموصي فاذا كان الموصي له جنينا او قاصرا او محجورا علية يكون قبول الوصية او ردها من له الولاية علي مالة بعد اذن المجلس الحسبي .
ويكون القبول عن الجهات والمؤسسات والمنشأت ممن يمثلها قانون فان لم يكن لها من يمثلها لزمت الوصية بدون توقف علي القبول .
موت الموصي له قبل الوصية اوردها
