يمنع من استحقاق الوصية الاختيارية أو الوصية الواجية قتل الموصي او المورث عمدا سواء كان القاتل فاعلا اصليا ام شريكا ام كان شاهد زور ادت شهادتة إلي الحكم بالاعدام علي الموصي وتنفيذة وذلك إذا كان القتل بلا حق و لاعذر وكان القاتل عاقلا بالغا من العمر خمس عشرة سنة – ويعد من الاعذار تجاوز حق الدفاع الشرعي .
