تصح الوصية بقسمة اعيان التركة علي ورثة الموصي بحيث يعين لك وارث او لبعض الورثة قدر نصيبة وتكون لازمة بوفاة الموصي فان زادت قيمة ما عين لاحدهم عن استحقاقة في التركة كانت الزيادة وصية .
