يجوز للعضو المقدم للمحاكمة التأديبية وهيئة التحقيق وهيئة التأديب أن يكلفوا بالحضور على يد محضر الشهود الذين يرون سماع شهادتهم ومن تخلف من هؤلاء الشهود عن الحضور بغير عذر مقبول أو حضر وامتنع عن أداء الشهادة أو شهد زورا أمام مجلس التأديب يحال إلى النيابة العمومية وتجرى فى شأنه أحكام قانونى العقوبات والإجراءات الجنائية .
