إذا حكم بقبول الطعن المشار إليه فى المادة السابقة بطلت قرارات الجمعية العمومية وأعيدت دعوتها إلى الاجتماع فى مدى ثلاثين يوما من تاريخ قبول الطعن .
وتدعى كذلك فى حالة الحكم ببطلان عملية الانتخاب بالنسبة إلى النقيب أو خمسة فأكثر من أعضاء مجلس النقابة فى مدة لا تتجاوز ثلاثين يوما من تاريخ الحكم بالبطلان فإذا كان عدد من أبطل انتخابهم أقل من ذلك سد محله من يليه من المرشحين .
