على إدارة الكسب غير المشروع إخطار النائب العام بالأمر الصادر بعدم وجود وجه لإقامة الدعوى خلال سبعة أيام من تاريخ صدوره وللنائب العام أن يطعن فى هذا الأمر خلال ثلاثين يوما من تاريخ إخطاره .
ويحصل الطعن بتقرير فى قلم كتاب محكمة الجنايات المختصة .
وتفصل المحكمة فى الطعن بعد سماع أقوال النيابة العامة وذوى الشأن فاذا رأت أن الأدلة كافية الغت الأمر وأحالت الدعوى إلى دائرة أخرى من دوائر المحكمة للفصل فيها .
