الشروع هو البدء في تنفيذ فعل بقصد ارتكاب جناية أو جنحة إذا أوقف أو خاب أثره لأسباب لا دخل لإرادة الفاعل فيها .
ولا يعتبر شروعا في الجناية أو الجنحة مجرد العزم على ارتكابها ولا الأعمال التحضيرية لذلك .
