لا تسري أحكام المواد ٣٠٢ و ٣٠٣ و ٣٠٥ و ٣٠٦ و ٣٠٨ على ما يسنده أحد الأخصام في الدفاع الشفوى أو الكتابي أمام المحاكم فان ذلك لا يترتب عليه إلا المقاضاة المدنية أو المحاكمة التأديبية .
