كل من خطف بالتحيل أو الإكراه طفلا ذكرا لم يبلغ ثمانى عشرة سنة ميلادية كاملة بنفسه أو بواسطة غيره يعاقب بالسجن المشدد مدة لا تقل عن خمس سنوات.

كل من خطف بالتحيل أو الإكراه طفلا لم يبلغ سنه ست عشرة سنة كاملة بنفسه أو بواسطة غيره يعاقب بالسجن . فإن كان المخطوف أنثى يعاقب الخاطف بالأشغال الشاقة المؤقتة .
