يعاقب بالسجن مدة لا تقل عن سبع سنوات كل من خطف طفلا حديث العهد بالولادة أو أخفاه أو أبدله بآخر أو عزاه زورا إلى غير أي من والديه.

كل من خطف طفلا حديث المهد بالولادة أو إخفاء أو أبدله بآخر أو عزاه زورا إلى غير والدته يعاقب بالحبس فان لم يثبت أن الطفل ولد حيا تكون العقوبة الحبس مدة لا تزيد على سنة أو غرامة لا تزيد على خمسين جنيها مصريا .
أما إذا ثبت أنه لم يولد حيا فتكون العقوبة الحبس مدة لا تزيد على شهرين أو غرامة لا تزيد على خمسة جنيهات .
