يعد في حكم الرشوة أن يقبل في شخص له صفة نيابية عامة سواء كانت النيابة بطريق الانتخاب أو بغيره وعدا بشيء ما أو أن يأخذ هدية أو عطية :
( ١ ) للحصول من أية سلطة عامة على أي التزام أو ترخيص أو اتفاق توريد أو مقاولة أو على وظيفة أو خدمة أو رتبة أو نشان أو مكافأة أو مزية أو للشروع في الحصول على شيء من ذلك .
( ٢ ) أو لاستعمال نفوذ مركزه النيابي حقيقيا كان أو مزعوما للحصول على أعمال أو أوامر أو أحكام أو قرارات من أية سلطة عامة أو للشروع في الحصول على شيء من ذلك .
