يعد مرتشيا كل موظف عمومي قبل وعدا من آخر بشيء ما أو أخذ هدية أو عطية لأداء عمل من أعمال وظيفته ولو كان العمل حقا أو لامتناعه عن عمل من الأعمال المذكورة ولو ظهر له أنه غير حق .
