لا يجوز إنشاء مشتل لتربية نباتات الفاكهة بقصد بيعها أو نقل مشتل من مكانه إلا بترخيص من وزارة الزراعة .
و يحدد وزير الزراعة بقرار منه شروط الترخيص والرسم الواجب أداؤه وتعفى الجهات الحكومية والمؤسسات العامة والهيئات العامة أو العلمية من أداء هذا الرسم .
