لا تسمع دعاوى المؤجر كما لا تقبل الطلبات المقدمة منه
الناشئة أو المترتبة على تطبيق أحكام المادتين ٣٩ ، ٤٠ إلا إذا كانت العقود
المبرمة وفقا لها مقيدة على الوجه المنصوص عليه فى المادة السابقة .
ولا يجوز للمؤجر الاستناد إلى العقود غير المقيدة لدى أية جهة من الجهات .
