مع مراعاة حكم الفقرتين الثالثة والرابعة من المادة 5 من القانون المرافق يصدر أول تشكيل للمحكمة الدستورية العليا بقرار من رئيس الجمهورية ويتضمن تعيين رئيس المحكمة وأعضائها ممن تتوافر فيهم الشروط المنصوص عليها فى القانون المرافق بعد أخذ رأى المجلس الأعلى للهيئات القضائية بالنسبة للأعضاء.
