جميع الدعاوى والطلبات القائمة أمام المحكمة العليا والتى تدخل فى اختصاص المحكمة الدستورية العليا بمقتضى القانون المرافق تحال إليها بحالتها فور تشكيلها وبغير رسوم.
وتحال إليها كذلك طلبات وقف تنفيذ الأحكام الصادرة من هيئات التحكيم القائمة أمام المحكمة العليا بحالتها دون رسوم للفصل فيها طبقا للأحكام الواردة فى القانون رقم 81 لسنة 1969 بإصدار قانون المحكمة العليا والقانون رقم 66 لسنة 1970 بإصدار قانون الإجراءات والرسوم أمامها.
