يعفى من الرسم كله أو بعضه ومن الكفالة كلها أو بعضها من يثبت عجزه عن الدفع بشرط أن تكون الدعوى محتملة الكسب.
ويفصل رئيس هيئة المفوضين فى طلبات الاعفاء وذلك بعد الاطلاع على الأوراق وسماع أقوال الطالب وملاحظات قلم الكتاب ويكون قراره فى ذلك نهائيا.
ويترتب على تقديم طلب الإعفاء قطع الميعاد المحدد لرفع الدعوى بعدم الدستورية.
