إذا رأت المحكمة أن الواقعة التى وردت بأمر الإحالة
أو غيرها من الوقائع التى تضمنها التحقيق تكون جريمة جنائية أحالتها إلى
النيابة العامة للتصرف فيها وفصلت فى الدعوى التأديبية .
ومع ذلك إذا كان الحكم فى دعوى تأديبية تتوقف على نتيجة الفصل
فى دعوى جنائية وجب وقف الأولى حتى يتم الفصل فى الثانية .
ولا يمنع وقف الدعوى من استمرار وقف العامل .
وعلى النيابة الإدارية تعجيل نظر الدعوى بمجرد زوال سبب الوقف .
