يكون انتخاب النقيب وأعضاء المجلس إجباريا ، ولا يجوز لأى عضو من أعضاء النقابة أن يتخلف بغير عذر يقبله مجلس النقابة أو مجالس النقابات الفرعية كل فى دائرة اختصاصه عن تأدية الواجب الانتخابى وإلا وقعت عليه غرامة قدرها جنيه واحد تحصل إداريا لحساب صندوق النقابة ويعتبر الصوت باطلا وتلغى بطاقة الانتخاب إذا انتخب العضو عددا أكثر أو أقل من العدد المطلوب انتخابه سواء لمجلس النقابة أو مجالس النقابات الفرعية .
