يقيم النائب العام الدعوى التأديبية بناء على طلب وزير العدل .
وللوزير وللنائب العام أن يقف عن العمل عضو النيابة الذى يجرى معه التحقيق إلى أن يتم الفصل فى الدعوى التأديبية .
وتتبع أمام مجلس التأديب القواعد والإجراءات المقررة لمحاكمة القضاة .
وأحكام هذا الفصل لا تمس الحق فى فصل أى عضو من أعضاء النيابة العامة أو نقله إلى أى وظيفة أخرى غير قضائية بغير الطريق التأديبى وذلك بعد موافقة المجلس الأعلى للهيئات القضائية .
