فى حالة وجود سبب من أسباب التنحى المنصوص عليها فى قانون المرافعات بالنسبة لرئيس مجلس التأديب أو أحد أعضائه وجب عليه التنحى عن نظر الدعوى التأديبية . وللعضو المحال إلى مجلس التأديب حق طلب رده .
