يصدر بالشروط التى يرى إلزام المفرج عنهم تحت شرط بمراعاتها قرار من وزير العدل ، وتبين بالأمر الصادر بالافراج تحت شرط الواجبات التى تفرض على المفرج عنه من حيث محل اقامته وطريقة معيشته وضمان حسن سيره .
