يجوز لكل من المتهم و لجنة التحقيق وهيئة التأديب أن يكلف بالحضور على يد محضر الشهود الذين يرى سماع شهاداتهم ، ومن تخلف من هؤلاء الشهود عن الحضور بغير عذر مقبول أو حضر وامتنع عن أداء الشهادة أو شهد زورا أمام هيئة التأديب يحال إلى النيابة العامة و تجرى في شأنه أحكام قانون العقوبات وتحقيق الجنايات الخاصة بمواد الجنح .
