تحيل المحاكم من تلقاء نفسها ودون رسوم ما يكون لديها من دعاوى فى مسائل الأحوال الشخصية على وجه الحسبة والتى لم يصدر فيها أى حكم إلى النيابة العامة المختصة وفقا لأحكام هذا القانون، وذلك بالحالة التى تكون عليها الدعوى.
ويعلن قلم الكتاب أمر الإحالة إلى ذوى الشأن.
