يعتبر شرط التحكيم اتفاقا مستقلا عن شروط العقد الأخرى . ولا يترتب على بطلان العقد أو فسخه أو إنهائه أى أثر على شرط التحكيم الذى يتضمنه ، إذا كان هذا الشرط صحيحا فى ذاته .
