إذا رفض الشهود الحضور إجابة لدعوة الخصم أو المحكمة وجب على الخصم أو قلم الكتاب حسب الأحوال تكليفهم الحضور لأداء الشهادة قبل التاريخ المعين لسماعهم بأربع وعشرين ساعة على الأقل عدا مواعيد المسافة .
ويجوز فى أحوال الاستعجال نقص هذا الميعاد وتكليف الشاهد الحضور بغية من قلم الكتاب بأمر من المحكمة أو القاضى المنتدب .
