إذا كان المحرر تحت يد الخصم جاز لرئيس الجلسة بعد اطلاعه على التقرير أن يكلف فورا أحد المحضرين بتسلم ذلك المحرر أو ضبطه وإيداعه قلم الكتاب .
فإذا امتنع الخصم عن تسليم المحرر وتعذر ضبطه اعتبر غير موجود ولا يمنع هذا من ضبطه فيما بعد إن أمكن .
