إذا لم يقم الخصم بتقديم المحرر فى الموعد الذى حددته المحكمة أو امتنع من حلف اليمين المذكورة اعتبرت صورة المحرر التى قدمها خصمه صحيحة مطابقة لأصلها ، فإن لم يكن خصمه قد قدم صورة من المحرر جاز الأخذ بقوله فيما يتعلق بشكله وموضوعه .
