لا تكون الدفاتر والأوراق المنزلية حجة على من صدرت منه إلا فى الحالتين الآتيتين :
( ١ ) إذا ذكر فيها صراحة أنه استوفى دينا .
( ٢ ) إذا ذكر صراحة أنه قصد بما دونه فى هذه الأوراق أن تقوم مقام السند لمن أثبتت حقا لمصلحته .
