يحصل التظلم بتقرير فى قلم الكتاب ويترتب على وفعه وقف تنفيذ الأمر وتنظر فى غرفة المشورة بعد تكليف الخبير والخصوم الحضور بناء على طلب قلم الكتاب بميعاد ثلاثة أيام ، على أنه إذا كان قد حكم نهائيا فى شأن الإلزام بمصروفات الدعوى فلا يختصم فى التظلم من لم يطلب تعيين الخبير ولم يحكم عليه بالمصروفات .
