تقدر أتعاب الخبير ومصروفاته بأمر يصدر على عريضة من رئيس الدائرة التى عينته أو قاضى محكمة المواد الجزئية الذى عينه بمجرد صدور الحكم فى موضوع الدعوى .
فإذا لم يصدر هذا الحكم فى الثلاثة الأشهر التالية لإيداع التقرير لأسباب لادخل للخبير فيها قدرت أتعابه ومصروفاته بغير انتظار الحكم فى موضوع الدعوى .
