للمحكمة من تلقاء نفسها أو بناء على طلب أحد الخصوم أن تقرر الانتقال لمعاينة المتنازع فيه أو أن تندب أحد قضاتها لذلك .
وتحرر المحكمة أو القاضى محضرا تبين فيه جميع الأعمال المتعلقة بالمعاينة وإلا كان العمل باطلا .
