يجوز الأمر بحبس المتهم احتياطيا فى أى مرحلة من مراحل الدعوى ولا يصدر الأمر بالحبس إلا من النيابة العسكرية أو رؤساء المحاكم العسكرية كل فى دائرة اختصاصه .
