يكون من أعضاء الضبط القضائى العسكرى كل فى دائرة اختصاصه :
١ ضباط وضباط صف المخابرات الحربية .
٢ ضباط وضباط صف الشرطة العسكرية .
٣ الضباط وضباط الصف والجنود الذين يمنحون هذه السلطة من نائب القائد الأعلى للقوات المسلحة أو من يفوضه فيما يكلفون به من أعمال .
٤ من يخول هذه الصفة بمقتضى قوانين أخرى أو قرارات صادرة تنفيذا لها .
