فى الأحوال التى ترتكب فيها الجريمة بواسطة شخص اعتبارى يعاقب المسئول عن الإدارة الفعلية لهذا الشخص الاعتبارى بالعقوبات ذاتها المقررة عن الأفعال التى ترتكب بالمخالفة لأحكام هذا القانون إذا ثبت عليه بها ، وكانت الجريمة قد وقعت بسبب إخلاله بواجبات وظيفته .
وفى جميع الأحوال ، تكون أموال الشخص الاعتبارى ضامنة للوفاء بما يحكم به من عقوبات مالية .
