يكون نطاق الرقابة الجمركية البحرى من الخط الجمركى إلى المسافة التى تباشر فيها الدولة سيادتها وفقا للقوانين والاتفاقيات الدولية النافذة ، وتحدد اللائحة التنفيذية لهذا القانون نطاق الرقابة الجمركية البرى وفقا لمقتضيات هذه الرقابة .
ويكون إنشاء الدوائر والنقاط الجمركية أو تعديلها أو إلغاؤها بقرار من الوزير أو من يفوضه .
